Comprehensive Environmental Site Assessments are frequently required by banks for financing real estate transactions and property development.

Atzl, Nasher and Zigler, P.C. will prepare an Environmental Site Assessments (ESA) to provide an informed understanding of the environmental condition of a property in accordance with United States Environmental Protection Agency (USEPA) Standards and Practices (AAI / 40 CFR Part 312) and American Society for Testing and Materials (ASTM) Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process / Designation E 1527-13 (ASTM) Standard Practice E 1527-13.

 PHASE 1

ESA can assist a potential land owner in making an educated decision, about the environmental condition of a property prior to acquisition. We will help you find out about conditions that may impact property value or result in claims against the innocent land owner in the future. The ESA reviews the current and previous uses of the property as well as neighboring properties to identify potential or existing risks. By performing a Phase I ESA, the purchaser creates a “Safe Harbor” known as the “Innocent Land Owner Defense”.

 PHASE 2

When the Phase I Environmental Site Assessment (ESA) identifies a potential environmental condition that may have caused soil and/or groundwater contamination, a more comprehensive investigation is warranted. A Phase II ESA is performed to determine if contamination is present. Atzl, Nasher and Zigler, P.C. will prepare an Environmental Site Assessments (ESA) in accordance with American Society for Testing and Materials, (ASTM) E1903-11 Standard Guide for Environmental Site Assessments: Phase II Environmental Site Assessment Process.
Phase II ESA uses various methods to further investigate the soil, soil vapor and groundwater for possible contamination. Based on Areas of Concern and Chemicals of Concern discovered in a Phase I ESA, an investigation will be designed to economically investigate areas with possible contamination to determine if a hazardous material or petroleum product is absent or present. In the unfortunate event that contamination is discovered, Atzl, Nasher and Zigler can provide innovative, cost effective solutions that mitigates the impact. We work with State Agencies and assist with cleanup contractors to ensure contamination is removed and areas are brought up to standard.
